VIEWPOINT ON JUDICIARY

It is by no means a fact that most crimes in our country are committed by very poor people. It is just that these dispensable and forgotten people are too powerless to free themselves from the vice-like grip of the law: they lack the money, education and political clout to walk free. They cannot muster the resources to afford bail and lawyers, and over burdened courts do not find the time to try them.

India has a long tradition of respecting women. Indian women have scaled the heights of glory in politics, literature, science, social work etc. The emergence of many women in politics has proved that our society can no longer deter capable women from being pivotal to decision-making.

OBAMAS AT NEW DELHI

New Delhi, the capital of India welcomed the Obamas after their sojourn at Mumbai for two days.
The Prime Minister of India, Manmohan Singh and his wife Madam Gursharan Kaur were in the Delhi airport to welcome the couple on the red carpet.
The couple descended the aircraft specially made for the President of the US – Air Force 1.
Shaking hands, hugging and exchanging pleasantries took few minutes; afterwards Obamas entered the black limousine waiting for them in the tarmac.
They visited the Humayun’s Tomb – a 450-year-old Mugal Monument located in 32-acre plot in South Delhi’s Nizamuddin area.
Obama lauded the architecture of the Tomb and spent some time with school children aged between five and 13 with whom Obama and his wife posed for a group photograph.
Also the Obamas distributed gifts to the children that comprised a two-and-half-inch silver bookmark with the US presidential seal which carried Mr. Obama’s signature.
I do not know how much the children liked their gift?
Still a gift is a gift especially for children who keep it as precious as possible.
Obama’s love for children was shown more than ones during his visit to India.
It would be a great inspiration for those children to meet, touch and speak to a person who is the President of a big country like the US.
The evening ended with a dinner hosted by the Indian Prime Minister in his residence on Race Course Road, New Delhi.
Fifty Indians and 20 Americans were the guests for the dinner.
Before the dinner one-hour time was spent on a one-on-one meeting between the American President and the Indian Prime Minister.
No one knows what they spoke.
Only the two leaders know.
May be the top secrets!
After the meeting the dinner was served and after the dinner everyone retired for the day with a hope that the President of the US will deliver a speech in the joint Parliamentary meeting on 8 November 2010.
Obama had meetings with Sonia Gandhi, the UPA chairperson and Sushma Swaraj the opposition leader of BJP at ITC Maurya Hotel where he stayed.
I would imagine that the two ladies might have been impressed by the charming Obama through his cultured conversation.
Since he was open minded to receive the opinions of leaders and try to convince them with his counter arguments, the two ladies might have satisfied fully.
Also Obama and his wife visited Mahatma Gandhi Samadhi at Rajghat.
They laid a wreath at the memorial of the Father of the Nation.
Since there was no space left for planting he could not plant a sapling as many others could do earlier.
He was very much impressed by the simple and beautiful place for the memorial.
He and his wife wrote in the guest book:
We will always remember the great soul who changed the world with his message of peace, tolerance and love. More than 60 years after his passing, his light continues to inspire the world.’
These two sentences carried the inner feelings of the Obamas and also expressed the principle of Gandhiji’s non-violence and the philosophy of simple life.
Obama presented a white stone brought all the way from Martin Luther king Junior’s Memorial in Washington D.C.
It was set on a small black base that had the Presidential seal and Mr. Obama’s signature embossed on it.
Obama also held delegation-level talks with Manmohan Singh and at the end addressed a press conference together.
The joint statements included a range of interactions between India and the US, from Afghanistan and outer space to the Indian Ocean, higher education, energy, agriculture and climate change.
In the evening, the President was brought to the Parliament Central Hall by Madam Meira Kumar, the Speaker of Lok Sabha and Mr. Hamid Ansari, Chairman of the Rajya Sabha.
In his 40-minute formidable address he paid glowing tributes to the rising India.
After addressing the common traditions and interests of the two countries, he pronounced what the parliamentarians wanted to hear and cheer.
The loudest applause came when said: ‘I look forward to a reformed United nations Security Council that includes India a permanent member.’
I presumed that it was only an expectation not a promise.
However, everyone was happy that they could hear from the President of the US such an expectation.
Another important segment of his speech liked by the parliamentarians and media was that he said: ‘We will continue to insist to Pakistan’s leaders that terrorist safe-havens within their borders are unacceptable and that terrorists behind the Mumbai attacks must be brought to justice.”       
Although not much comes out of his statement, still he as the President of the US spilled out this much to send a message to the Pakistan authorities.  
More than that is not possible to expect from Obama.
He talked about green revolution, climate change, democracy, Burma (Myanmar), Iran and many other aspects both counties have to involve.
The walls of Parliament Central Hall would not have heard or the past Indian leaders’ portraits kept over there would not have heard such an extraordinary diplomatic speech embedded with optimism and hope.
A standing ovation for the President of the US brought the end of the function which was followed by a dinner hosted by the President of India, Pratibha Singh Patil to make a happy ending to Obama’s state visit to India.
One cannot forget the good words Obama stated at the Rashtrapati Bhavan.    
One thing I observed during my visit was that India is doing so well because it has so many strong women leaders.”
Every Indian woman should be proud of the President’s statement.
Education is the primary key to open the door for women to go a long way to occupy the leadership of a democratic country like India.
One the whole, in brief, the visit of Obamas to India went on very well, peaceful and satisfied many minds which had doubts and fear.
Security alert was very strict and the safe stay of Obamas and their officials in India has to be remembered for ever by one and all.

OBAMAS IN MUMBAI - PART 2

In fact, the second day of stay at Mumbai was a memorable one for both Obamas.
Celebrating Diwali with school kinds by dancing with them might have relaxed the couple a good deal and also for millions of Indians, it was a great sight.
The President and the First Lady of America enjoyed the dance with Indian children at Holy Name High School at Colaba might have brought to their mind their own two sweet daughters.
Kids always bring down tensions in the minds of people whether they are Presidents or residents of any country.
After a light time, the Obamas moved to meet the 300 selected college students from various local colleges at one of the oldest colleges of Mumbai – St. Xavier’s College.
Michelle Obama welcomed the youths – boys and girls – and introduced her husband and asked him to face some tough questions from the budding leaders of India.
Barack Obama as usual came to the open dais of the basket ball court briskly walking and took the microphone.
There was a standing ovation from the assembled crowd which was dotted with security personals both from the US and India.
Obama was wearing a white shirt and black trousers.
He gave a speech explaining the purpose of his visit and also his high regard for Indians and Indian culture and above all Mahatma Gandhi.
He also mentioned that India is a role model for the world as far as democracy and green revolution are concerned.
The inspiring speech loaded with optimism might have certainly inspired and motivated the Mumbai college boys and girls.
Obama told the students - the future innovators, educators and entrepreneurs – that they have to think of future India and its relevance in the growing world in cooperation with the United States of America.
Obama was not in a hurry; he took his own time enjoying the company of the young ones of India.
He invited questions from those young ones to answer, for which he picked up a girl who rose her hand first, which was followed by a boy then a girl alternately.
It was at random.
No one knows whom he was choosing and what sort of question he was expecting.
Everything went on in an order.
The students asked some inconvenient questions such as jihad, Kashmir, spirituality, Mahatma Gandhi etc.
They were the real tough questions for the President. 
Very patiently, Obama answered those questions and also all those who watched the session from all over the world including me.
He talked about terrorists, religious fanatics, non-involvement of the US in Kashmir issue, Pakistan’s difficulty in controlling the Talibans in its border, his partial follow up of Gandhi’s ideals, simplicity in life, climate change, students role in building up a nation, universities in both India and the US and a whole lot of issues which are essential information for the student community.
He did mention that a stable Pakistan is good for India because India is on the move.
He also said that the history between India and Pakistan is incredibly complex and was born of much tragedy and violence.
His hope was, over time, trust develops between the two countries.
That dialogue begins perhaps on less controversial issues building up to more controversial issues.
And over time there is a recognition that India and Pakistan can live side by side in peace.
It was good on the part of the students to get all these words from the Lion’s mouth.
Many politicians and Indian media in fact, wanted to hear these words from Obama on the first day of his arrival at Mumbai.
I am quite sure that every student who was seated there in the open auditorium should have enjoyed and got inspired by the speech of the President.
It was a historic event in their life to hear Obama so close and near.
Every one will be considering this great opportunity as one of the milestones in his or her path of life.
After completing the session Obama shook hand with many students who might have very much wanted the wonderful opportunity of touching the great man of today’s world.
His wife Michelle was signing autographs of the students.
The security took the Obamas to the Chhatrapati Shivaji International airport and they were aboard Air Force One to fly to New Delhi in the afternoon.
The Mumbai police had a sigh of relief because 43,000 staff was put on duty to make a perfect security arrangement for the visiting American President.

OBAMAS IN MUMBAI - PART 1


Finally the Obamas landed in Mumbai on 6 November 2010, a day after Dewali, the festival of light.
In fact, Dewali is a festival of fireworks, new dresses and good food.
With the festive mood India was anxiously waiting for the arrival of Barrack Obama and Michelle Obama taking all possible security measures both in Mumbai and New Delhi.
The President of the U.S. who stands for the security and prosperity of the Americans said
“Mumbai is a symbol of incredible energy and optimism that defines India.”
Well said by Obama!
The Obamas stayed at Taj Mahal Palace and Tower Hotel Mumbai as a mark of showing solidarity with those who lost their precious lives during the 26/11 terror attack.
Obama called it as the historic hotel.
He gave a brief speech for about 10 min explaining the purpose of his visit in a nutshell without entering into the controversial issues such as Kashmir and Pakistan.
As the President of the US he was very cautious in using the words to keep good relations with countries like Pakistan, Afghanistan, Iraq and other countries.
After hearing the speech which lacked the required excitement s for Indian media, called some of the routine panel members from press, political parties and academics and discussed Obama’s speech all through the day.  
Most of the panel members were unhappy that Obama did not mentioned that the 26/11 terrorists came from Pakistan.
Also they were not happy that Obama did not mention Pakistan in his brief speech.
One of the PBP leaders said Obama’s statement was disappointing!
How is it possible for a President of a big country like the US which is giving aid to Pakistan to quell the terrorists to talk bad about Pakistan that too in India?
I was disappointed by the Panel members of the media who have lot of experience in political affairs could not understand the diplomatic way of putting things.
Barack Obama knows what he speaks.
He is a very good speaker, motivator, and optimist.
People may say anything because of prejudice to Americans, but America is one country which recognized the Americans who are the people belonged to various parts of the world.
Electing Obama as the President of the US itself is a great honor for the American people.
Young and energetic from the Democratic Party Obama took up the Presidentship when the economy of the US was in doldrums and the wars in Iraq and Afghanistan were on.
‘Things can not happen overnight’ – as Obama says.
Political systems in the world are changing.
Weak governments without good majority are destroying the democracy day by day in many nations.
Death and destruction are the paths terrorists take to achieve their goals.
‘How to change such attitudes?’ – is a very big question grinding the minds of Presidents and Prime Ministers of many countries.
In the afternoon of 6 November 2010 while addressing the US-India Business and Entrepreneurship Summit, President Obama announced deals worth $10 billion between India and the US for creating more than 50,000 jobs back in the US.
Trade between India and the US has to grow with competitive spirit was the opinion of Obama.
Obama asked India to ease trade barriers to open up market access.
India has to participate, compete and win the world trade by following up the deals announced by President Obama.
Indian Industrialists – small and big, manufacturers, technologists should come forward to capture the US market.
We have intellectual human resources and also products for export.
We have to transform India a better place to live for the billion and odd Inidans.

JUDICIARY – A NEED FOR CHANGE

Our life and administration have undergone sea changes.
A calm life has become a busy one.
The number of people on the planet has increased to more than 10 billions.
The need of the population has enormously augmented because of the greed.
The administrative changes are made to suit certain situations.
People, who are in the helm of affairs, keep silent on many issues which are likely to affect them.
Therefore, the law and order in many countries have lost their control.
The judgment has lost its charm.
The judges have become biased and corrupt according to people who are affected.
In some cases, they are kind towards criminals and the punishment awarded is not implemented.
It takes years to settle a case; even the criminals agree that they have committed the crime.
It’s all because of the volumes of law-books written by someone who lived in a century which has not dreamt of the changes of today and the future.
Those rules are not suited for today’s world and today’s unlawful activities. 
Because of the advancement of electronic technology, it is easier to commit a crime and escape.
Government spends so much energy and money to capture the unsocial elements.
The process of enquiry starts afterwards for years together to arrive at a conclusion.
The enormous number of cases pending in courts is a burden both for the clients and the judges.
Depending on the severity and cruelty of cases, the punishment has t o be awarded with available clear evidences.
The judges have to be given the freedom to punish the persons who are caught red handed.
Nowadays, in a vast country like India, villagers migrate to developing and developed cities in search of work.
Some fortunate ones get the work whereas most of them do not get work.
So they think of short-cut ways to earn money.
They pick pockets for money, jewels and other valuables, steal vehicles, kidnap kids for ransom etc. etc.
Even educated persons are also involved in such illegal activities.
In a recent incident at Chennai, an engineering graduate with MBA from a foreign university and a diploma holder in Mechanical Engineering kidnapped a 13-year-old boy.
The police nabbed the culprits with all clear evidence.
How much time is required for a judge to write a judgment for this case? 
Severe punishment only can bring down such unwanted, unsocial elements in a society.
Those who do not have fear on petty punishments and judgments, continue to involve in illegal activities.
Judiciary has to think very seriously on the mode of judgment and award of punishment.
It is high time to think of right changes to create a fear in the minds of millions of people who do not unsocial activities.
Corruption, rape, kidnapping, stealing, cheating, killing are cases handled by police and lawyers without awarding severe punishments.
Nowadays people know fully well that the judiciary is a way out for getting off from wrong-doing.
I feel that the judiciary has to be strong enough to inject an element of fear in the minds of people by punishing severely.
There are many flaws in judiciary – everyone complaints – but no one is thinking seriously on improving and changing the system.
If we continue with the out-dated judicial laws, we may end up in more crimes and unsocial activities in our country.
My Lord, kindly look into it…Judicial Reforms – the need of the hour!
